Taniv Overseas – Deliver Beyond Boundaries

These Terms & Conditions govern all export transactions, communications, and use of services provided by Taniv Overseas, a proprietorship firm registered in India and engaged in the export of food products, agricultural commodities, and permitted non-food items. 

By accessing our website, placing an order, or entering into any commercial arrangement with Taniv Overseas, the buyer agrees to these Terms & Conditions. 

  1. Company ProfileTaniv Overseas is a proprietorship firm engaged exclusively in export activities. The company operates in compliance with: 
  • Indian laws and regulations 
  • DGFT (Directorate General of Foreign Trade) rules 
  • FSSAI Central License conditions (where applicable) 
  • APEDA and Customs regulations 
  • Importing country laws and standards 
  1. Nature of Business (Export Only)

Taniv Overseas undertakes export-only operations. 
No food or related products are sold, supplied, or distributed within the domestic territory of India. 

  1. Product Information & Compliance
  • Products are exported strictly as per buyer-approved specifications, samples, packaging, labeling, and contractual terms. 
  • Compliance with importing country regulations is the responsibility of the buyer unless otherwise agreed in writing. 
  • Any statutory inspection, testing, or certification required shall be mutually agreed prior to shipment. 
  1. Pricing & Payment Terms
  • Prices are agreed through invoices, contracts, or purchase orders. 
  • Payment modes may include Advance Payment, Letter of Credit (LC), DP, or DA, as mutually agreed. 
  • All bank charges, foreign exchange costs, and international transfer fees shall be borne by the buyer unless stated otherwise. 
  • Delayed payments may attract interest or suspension of further shipments. 
  1. Shipment & Delivery
  • Shipment timelines are indicative and subject to logistics, customs clearance, port conditions, and regulatory checks. 
  • Risk and title of goods transfer as per agreed Incoterms®. 
  • Taniv Overseas shall not be liable for delays caused by shipping lines, port authorities, customs, force majeure, or government actions. 
  1. Inspection & Claims
  • Buyers must inspect goods upon arrival at destination. 
  • Any claim relating to quantity, quality, or condition must be notified in writing within 7 days of receipt, supported by documentary evidence. 
  • Claims raised after this period shall not be entertained. 
  1. Refund & Cancellation Policy

7.1 Cancellation 

  • Orders once confirmed cannot be cancelled if production, packaging, procurement, or shipment has commenced. 
  • Cancellation requests must be submitted in writing and will be considered on a case-to-case basis, subject to incurred costs. 

7.2 Refund 

  • Refunds are not applicable for goods already shipped or exported, in accordance with international trade practices. 
  • Any refund, if approved, shall be limited to the value of goods not shipped and after deduction of applicable expenses including procurement, processing, banking, logistics, and documentation costs. 
  • Refunds shall be processed through the original banking channel and currency, subject to RBI and FEMA regulations. 

7.3 No Refund Situations 

Refunds shall not be granted in cases of: 

  • Change in buyer requirements after confirmation 
  • Import restrictions or regulatory changes in buyer’s country 
  • Delays caused by customs, port congestion, or force majeure 
  • Buyer’s failure to obtain import licenses or clear goods 
  1. Limitation of Liability

Taniv Overseas’ liability, if any, shall be limited strictly to the invoice value of the goods supplied. 
The company shall not be liable for indirect, incidental, consequential, or commercial losses. 

  1. Force Majeure

Taniv Overseas shall not be responsible for failure or delay in performance due to events beyond reasonable control, including but not limited to: 

  • Natural disasters 
  • Pandemics 
  • War or political unrest 
  • Government actions 
  • Port strikes or logistics disruptions
  1. Intellectual Property

All trademarks, logos, documents, website content, and branding belong exclusively to Taniv Overseas unless otherwise agreed in writing. 

  1. Governing Law &Jurisdiction
  • These Terms & Conditions shall be governed by the laws of India. 
  • Any dispute arising out of export transactions shall be subject to: 
  • Applicable DGFT or statutory authority procedures, and 
  • Exclusive jurisdiction of the Hon’ble Calcutta High Court, Kolkata 

International courts shall not have jurisdiction unless expressly agreed in writing. 

  1. Amendments

Taniv Overseas reserves the right to modify or update these Terms & Conditions at any time. 
Revised terms shall be effective upon publication on the official website. 

  1. Acceptance

By placing an order, entering into a contract, or engaging in business with Taniv Overseas, the buyer confirms acceptance of these Terms & Conditions in full.
